This conference will include:
Do examiners help or hinder a restructuring case? Are their costs justified? Increased scrutiny is coming
.
Using independent, third-party examiners to investigate, analyze and report on pre- and post-bankruptcy matters is supposed to aid the Court and the parties in administering the case. In reality, though, examiner practices and reports often raise more questions than answers, and expensive litigation follows.
Invest in this Audio CD (recorded late February 2008) to hear nationally renowned restructuring attorney Tom Salerno discuss the latest developments in the use of examiners. Hell also review the basic roles and responsibilities of examiners and examine both sides of the question of their cost-benefit.
You'll discover:
What are the rules for appointing examiners in Chapter 11 cases? What rights and appeals do creditors and debtors have in the process?
Examiner powers what are the legal limits?
How much discretion do the courts have in assigning duties?
Who is qualified to be an examiner?
Who pays and how are fees determined?
Evidentiary issues regarding examiner reports Great report! Now what do we do with it?
The examiner report as public record To seal or not to seal. That is the question!
What risks and liabilities if any do examiners face?
Lessons learned from the use of examiners case law, rules and opinions
What changes are on the horizon?
